*UPDATE x2* Steny Hoyer's "Bad Date" FISA legislation

When I heard that FISA was back, and this time at the behest of our own side, I determined that I wouldn't get complacent... that's what this is all about:  If they keep bringing it up, and we stop caring, the Bush Administration and the complicit telecoms will get away with spying on us and abridging our rights.  

This is not good bipartisanship, this is the bipartisanship of a bad date: they walk out on you, and you get to pay the bill.

It's even worse than expected. When you read it, it's actually hard to believe that the Congress is about to make this into our law. Then again, this is the same Congress that abolished habeas corpus with the Military Commissions Act, and legalized George Bush's warrantless eavesdropping program with the "Protect America Act," so it shouldn't be hard to believe at all. Seeing the words in print, though, adds a new dimension to appreciating just how corrupt and repugnant this is.

"Protection of Persons Assisting the Government" it's called.  Really, Majority Leader Hoyer?  How about "Protection of Persons FROM the Government?"  Because that's what I'm concerned with right now.

The bill provides another sunset clause, to be sure.  The reason I was on-board with these other extensions was because I knew that they were just running out the clock until Bush leaves office.  There's just one problem this time: the sunset isn't until 2012... just in time to be an issue in another election year!

Here's what our good friend Russ Feingold says about it:

The proposed FISA deal is not a compromise; it is a capitulation. . . . The House and Senate should not be taking up this bill, which effectively guarantees immunity for telecom companies alleged to have participated in the President's illegal program, and which fails to protect the privacy of law-abiding Americans at home. Allowing courts to review the question of immunity is meaningless when the same legislation essentially requires the court to grant immunity. And under this bill, the government can still sweep up and keep the international communications of innocent Americans in the U.S. with no connection to suspected terrorists, with very few safeguards to protect against abuse of this power.

We have to do something, folks.  

Here is what I wrote to my Senator.  It is a little too late to go after Representatives, since they're voting today and I doubt they'd let this go to the floor if they weren't confident that it was bought and paid for, but we can kill this thing in the Senate if we can get through to our progressive Senators.

Senator Klobuchar:

The event that inspired me to write to you for the first time was the FISA issue last year, and again the problem resurfaces.  I'm given to understand that the House of Representatives appears to be caving in to George W. Bush's desire to get telecom immunity in a "compromise" that seems more like being stuck with the check when your date walks out on you rather than a true compromise between equals.

The compromise bill introduced by Representative Steny Hoyer appears to be congigent on the Justice Department being fair and impartial; with perfectly honest attorneys getting fired for not politicizing their job, and appointments being made based less on impartiality and understanding of the law than loyalty to a Bush Administration that has repeatedly pushed the rights of large companies to the forefront, can we trust that a federal judge will rule with an eye on rights of average Americans such as myself?  Or will they cover for the big telecoms that sold us out?  I would like to point out that one Minnesota telecom, Qwest, knew was wrong from the start and refused to participate.

I'm sure that I don't need to remind you that just last week, the right universal in civilized nations, habeas corpus, was upheld by the Supreme Court by a very sparing majority, due in part (ironically) to conservative activist judges looking to protect the failed war policies of the Bush White House.

I do have faith in our system; that's why I'm writing to you today.  If the House of Representatives passes this "bad date" legislation, it will fall upon people like yourself and Senator Russ Feingold to stand up for my right to not be spied upon, and against big-money criminals and collaborators with an abusive and unpopular government.

Get out there and make a difference, folks.  Find your Senators and let them know that you are more concerned with the Consitution and privacy and justice than you are with some complicit telecoms (and George W. Bush) getting off the hook.

just got charged long distance twice.

Sen. Obama didn't answer the phone, apparently every one and their mom is calling right now. Called Rep. Silvestre Reyes' office, apparently  he's gonna approve the bill [color me surprised] hes the chair of the HOuse Intelligence Committe;  I talked with his secretary and we got in this big fight over the damn bill. He kept repeating that its a good balance. told me that even Nancy Pelosi is supporting it. Said that because it was an issue of National security some things have to be kept secret otherwise terrorists would know we were investigating them. kept saying it wouldn't grant them, telecom, immunity.

he also told me they are discussing the bill as I type.

Regardless of what he does or doesn't do, he should have spoken up on this 16 hours ago when the "compromise" was announced. I've been a supporter of his since 2004, have donated over $200, and have been on this blog defending him throughout the dark days of December-May. I'll continue to do so but it's a nice reality check that these people are but bit actors in specific policy goals the progressive movement must be pushing.

A 'nay' vote isn't enough. He's got the bully pulpit and in his first test of strength it looks like he's gonna fail. He needs to be in the chamber organizing a filibuster of the final bill, whenever that comes. And in the meantime he needs to open his mouth, and open it now.

Since my congressman is irredeemable I've been calling Obama's offices most of the afternoon - have gotten through a few times and they say they're getting flooded with calls. Keep it up.

When he tells the press that he basically wants to kill the bill but too many other Democrats want to pass it, that's being a chickenshit about to fail.  If he said "Listen, this is the best we think we can do on this bill, it is what it is".  I would say fine, screw you, you're a terrible leader but at least I respect you for telling the truth about an ugly situation.  Blaming it on the Democratic caucus is a cowardly move...."It's not me, honestly, it's all of them..." pfffft.

I originally posted that I was witholding my GE campaign contribution to Obama because of this debacle and his lack of firm leadership of the DNC powerbrokers.  However, should he actually do something to make this right: i.e. have telco immunity stripped from the bill, all will be right in my little corner of the world.

I understand that.  This is how I will show my displeasure at both the DNC leadership (and lack thereof) and Obama's inability to pull his party into line.  All actions have consequences and while mine are extremely small in the grand scheme of things, short of not voting or voting for McCain, this is the best that I can do.

Just to put it in perspective, I was so angry this morning listening to the presser Bush did explaining (errr lying) about how this is such a good piece of legislation, that I was actually screaming at the top of my lungs as I was driving down the road.  Screaming, loud, guttural, angry screams that the Democrats had once again given in to the false sense of fear that permeates this administration.  I was so angry that I went to the Montgomery County Board of Elections and filed to change my party affiliation to Independent.  I have since calmed considerably, but for me, this was a make or break moment and it once again showed what a weak, feckless party we have (or at least the leadership is).

It also made me think that the Democratic Party Leadership is like a battered spouse.  We continue to take it on the chin from the GOP, trying to rise above it and "be better than that".  Problem is, they are legislating from the minority and continuing to fuck the country with impunity.  This country, and the Democratic Party in particular, hasn't hit "rock bottom".  We will continue to lose these battles until we grow a backbone and fight back.  And until that day happens, the DNC can kiss my no-sending-money ass.

That's all well and good, but if your kid pours wine on the carpet or puts peanut butter in the dvd player, you don't hold onto that and use it later.  You punish them immediately so that they learn that their actions have clear, direct, and immediate consequences.  Their actions have shown, once again, that they feel they don't have to answer to people -- especially during this election cycle.  They obviously feel that since everyone is pissed at Bush, people won't care what they do.  Uh-uh Steny.  I care what you do - My wallet cares what you do.  That's $4,600 you guys won't be getting.  That's 2,300 Obama yard signs, that .01% of an ad buy, that's 9,200 campaign buttons that they will have to pay for with someone else's money.

Like I said above, Feingold is going to fight this.  Amy Klobuchar was the Hennepin County attorney here in Minnesota; she's got a strong law enforcement streak.  I'm hoping to get some leadership out of her.

The congresspeople are all individuals.  If we can lean on them individually, we can maybe get some accountability.

If anyone here uses Twitter, there are a few Congressmen using the service who regularly respond to messages. Tim Ryan (D-OH) and John Culberson (R-TX) are both tweeting from the floor. I think this tool could be useful for lobbying since most of these guys vainly check it every few minutes, or get messages pushed to their blackberries. www.twitter.com/timryan and www.twitter.com/johnculberson, respectively.

Anyone else know of any other elected-critters using the service?

We've had environmental bills killed just by having the court transcriptionist read aloud the entire thing from front to back every time it's brought up.  

The problem is that this bill is tied into tons of financing for other areas; it'll take some working to fix it.

If enough people come out and attack it, the bill will not pass.

Look at what happened when Dodd filabustered it before, it was stopped until now and we can push for it to be stopped again.

I wonder if Dodd's up for starting his marathon filabuster next week..

Either way we should be contacting all of our senators at this point.
